Se ordenó a la Subsección B de la Sección Cuarta del Tribunal Administrativo de Cundinamarca asumir de forma inmediata el conocimiento de la tutela presentada por el ciudadano de la referencia contra la Sala Administrativa del Consejo Superior de la Judicatura y la Sala Plena de la Corte Suprema de Justicia.
Lo anterior, toda vez que la Corte considera que, en estas específicas circunstancias y con el fin de permitir el goce efectivo de las garantías constitucionales de imparcialidad y de segunda instancia en el trámite de tutela, las reglas de competencia del Decreto 1382 de 2000 no son aplicables, por lo cual habrá de acudirse a la regla general en materia de competencia señalada en el Art. 37 del Decreto 2591 de 1991.
